Major Marketers Cited in Widespread Subsidy Abuse

Major oil marketers comprising Oando Plc, Forte Oil Plc, Total Nigeria Plc and MRS Plc, among scores of other independent oil marketers and importers of petrol, have been named by a Federal Government committee as having commited multiple infractions in the fuel subsidy scheme.
Details of the 17 infractions, which were exclusively reported by THISDAY yesterday, are contained in the report of the verification committee headed by the Managing Director/Chief Executive Officer of Access Bank Plc, Mr. Aigboje Aig-Imoukhuede.
The report also showed that despite the payment of N451 billion as 2011 subsidy arrears from the N888 billion earmarked for subsidy payments in the 2012 budget, the Nigerian National Petroleum Corporation (NNPC) and private oil marketers still have outstanding claims of N384,450,487,333.99 to be paid by the Federal Government.
Independent oil marketing companies fingered in the report include Capital Oil & Gas, NIPCO Plc, SPOG Petrochemical Limited, Sahara Energy Limited, Masters Energy, Honeywell Oil & Gas, Rahamaniyya Oil & Gas, Atieo Energy Resources Limited, Eterna Plc, Obat Oil & Petrol Limited and Folawiyo Oil Limited, among others.
The report showed that the oil marketers committed a wide range of infractions ranging from lack of evidence of sales proceeds in commercial banks, to the non-payment of a N20 million re-engagement fee for non-performance in the area of petrol importation, which should have been surcharged by the Petroleum Products Price Regulatory Agency (PPPRA).
For instance, of 857 transactions reviewed by the committee, 112 transactions were discovered as not having evidence of sales proceeds based on banks' available records at the date of verification.
The total subsidy claims in respect of these transactions was N157,549,854,482.55.
Similarly, 88 companies were discovered to have collected subsidies amounting to N121,897,757,962.56 without the signatures of external auditors and independent inspectors on shore tank certificates.
Marketers, which were identified by the committee to have commited infractions, will have the over-payments ascribed to them deducted from their outstanding subsidy claims, presidency sources revealed.
The report also showed that the total outstanding arrears owed the private marketers from 2011 amounted to N67,298,074,641.03, while the outstanding NNPC claims was N317,152,412,692.96.
Both NNPC and the marketers made total claims of N2,109,386,944,946.92 in 2011, with the corporation claiming N981,734,423,649.56 while the oil marketing and trading companies submitted claims amounting to N1,127,652,521,297.36.
The committee’s report, however, noted that outstanding arrears from 2009 and 2010 subsidies were included in NNPC’s claims for 2011.
Of the N981.7 billion claims submitted by NNPC for 2011, the corporation paid itself N764,944,448,471.72 by deducting it directly from the cost of crude oil allocated to it by the Federal Government.
NNPC also deducted another N210 billion in 2012, leaving N6.78 billion as government’s outstanding obligation.
But in 2012, the corporation submitted fresh claims of N310,362,437,515.12 as arrears of 2009, 2010 and 2011, bringing its total outstanding arrears from 2011 to N317.15 billion.
Of the N1.125 trillion claims made by the oil marketing and trading companies in 2011, the Federal Government paid N866,665 billion to the marketers in 2011, while another N246.171 billion was paid in 2012 as part of the 2011 arrears, leaving a balance of N12.8 billion.
However, in 2012, the marketers submitted additional claims of N54.48 billion as arrears of 2011, bringing their total unpaid arrears to N67.298 billion.
Of the N888.1billion earmarked for subsidy payments in the 2012 budget, a total of N231.8 billion was meant for the payment of the 2011 arrears.
But the payment of the arrears has gulped N451 billion, with N384.45 billion outstanding, which prompted the Minister of Finance and Coordinating Minister for the Economy, Dr. Ngozi Okonjo-Iweala, to suspend the payment of both the arrears from 2011 and claims for 2012, pending the completion of the forensic audit and verification exercise undertaken by the committee.
Meanwhile, oil marketers yesterday called for the immediate payment of all valid outstanding claims for 2011 and 2012.
The marketers also urged the finance ministry to ensure the immediate resumption of the issuance of Sovereign Debt Notes (SDN) by the Debt Management Office (DMO) for all legitimate transactions that have been completed and audited.
In a statement, the marketers said due to the fact that the issuance of SDNs for 2011 arrears and the current 2012 petrol import transactions were initially delayed and now currently suspended, they now have huge outstanding, verified and unpaid subsidy claims in excess of N200 billion with the Federal Government.
They argued that the non-reimbursement of the subsidy claims impairs the ability of any company to meet its obligations to the banks for loans advanced for the purpose of importing petrol under the scheme.
The marketers said conflicting statements by senior government officials on the adequacy or inadequacy of the amount appropriated for subsidy in 2012 and the subsequent halt in issuance of the SDNs, has led to an atmosphere of extreme uncertainty in which most banks are reluctant to provide further funding for importers.
Others, the marketers said, are only willing under extremely severe and uneconomic terms to fund their companies.
“Based on the foregoing, we hereby request that as a matter of extreme urgency and as the only means to ensure continued importation and supply of regulated products (petrol and kerosene), the following actions are taken: the Ministry of Finance ensures the immediate resumption of the issuance of SDNs by DMO for all legitimate transactions that have been completed and audited;
•PPPRA ensures conclusion and calculation of all outstanding legitimate claims (including but not limited to foreign exchange and interest rate differential claims) by June 30th, 2012;
•Ministry of Finance ensures cash backing for the SDNs that have already been issued and payment effected;
•All valid outstanding claims for 2011 and 2012 are paid without further delay as well as a statement assuring the finance community of the Federal Government’s ability and willingness to make good its obligation to importers in relation to the subsidy scheme be issued by PPPRA and the office of the Honourable Minister of Finance.”
The Federal Government committee was made up of Aig-Imoukhuede (chairman); Director General, Budget Office of the Federation, Dr. Bright Okogu; Dr. Director General, Debt Management Office, Dr. Abraham Nwankwo; Accountant General of the Federation, Mr. Jonah Otunla; and Executive Secretary, Petroleum Products Pricing and Regulatory Agency (PPPRA), Mr. Reginald Stanley.
Other members included former Group Executive Director, Finance and Accounts, Nigerian National Petroleum Corporation (NNPC), Mr. Michael Akorodare; Deputy Director, CBN, Mrs. Onyinye Ahuchogu; Mrs. David-Borha; National Secretary, Independent Petroleum Marketers Association of Nigeria (IPMAN), Mr. Mike Osatuyi; and Executive Secretary, Major Marketers Association of Nigeria (MOMAN), Mr. Obafemi Olawore.
In addition to the efforts by the finance minister to eliminate graft in the subsidy scheme and improve the management of the PSF, the Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, last January set up a number of task forces to reform the oil and gas sector.
One of such task forces is the 11-panel headed by Mr. Dotun Sulaiman on governance and controls in NNPC and other parastatals under the petroleum ministry.
The other is the Udo Udoma Petroleum Industry Bill (PIB) Special Task Force, which is working with a technical committee that is reviewing all versions of the bill to produce a new draft, while a third is the Nuhu Ribadu Petroleum Revenue Special Task Force meant to enhance probity, transparency and accountability in the operations of the petroleum ministry.
A fourth is a task force chaired by Dr. Kalu Idika Kalu to review the operations of the nation's four refineries and proffer solutions to optimise performance of the plants.

Court Of Appeals Orders EFCC To Retry Kenny Martins And Three Others For N 7.7Bn Police Equipment Fraud

The Court of Appeal sitting in Abuja has ordered the retrial of Chief Kenny Martins and three others in respect of the embezzlement of Seven Billion, Seven Hundred and Forty Million Naira (N7,740,000,000.00) belonging to the Police Equipment Fund.
In a well-considered judgment delivered by Justice Regina Nwodo, JCA, Leading two other justices on Thursday June 28, 2012, the appellate court among other issues, held that the four accused persons have a case to answer and that Justice Mohammed Talba of the FCT High Court misdirected himself and was wrong to have discharged the accused persons on a no-case submission.
The Appeal arose from a criminal charge preferred by the Economic and Financial Crimes Commission (EFCC) against Chief Kenny Martins, Ibrahim Dumuje, Yaro Gella and Nigerstalg Limited.
After the trial at the High Court, the accused persons were discharged on a no-case submission. However, dissatisfied with the ruling, the EFCC filed an appeal.
On the issue of bias, on which basis an Abuja Magistrate court and a Federal High Court, Abuja had disqualified prosecution counsel, Festus Keyamo from prosecuting the accused persons, on the grounds that he had written several petitions against the accused persons in the past, the Court of Appeal held that a prosecutor cannot be disqualified from prosecuting a matter based on allegations of bias.
The court ordered that the case file be remitted to the Chief Judge of FCT for reassignment and re-trial of the accused persons.

Everyone has been asking the question ‘Where General Pype de?’ for a few months now because we haven’t heard material from at least one good year, neither did we get the album he was supposed to release after his big hit Champion and it’s remix.

21 killed as gunmen, JTF clash in Kano, Yobe

KANO — No fewer than 17 Islamist militants were killed, yesterday, in Kano after two days of sustained exchange of fire between the militants and security agents. Four others were also reportedly killed in Damaturu, Yobe State capital. It was gathered that three undergraduates were among those arrested by security agents.
The gunmen had reportedly launched an operation, attacking seven targets with explosives and  assault rifles in Kano during the attack that lasted about 12 hours.

The military Joint Task Force, JTF, reportedly killed two of the attackers in Damaturu, while one was arrested in the 30-minute fierce battle that later spread to the Federal Polytechnic, Damaturu, premises.
It was alleged that a group of unknown gunmen, suspected to be terrorists, had earlier attacked a police out-post in Sabon Fegi ward in the metropolis, killing two civilians. A woman and her child were hit by stray bullets during the exchange of gunfire between the gunmen and men of JTF.
Kano State Commissioner of Police, Ibrahim Idris told newsmen in Kano that the gunmen attacked their targets with explosives and assault riffles, adding that no fewer than 14 Improvised Explosive Devices, IEDs, were defused by the Bomb Disposal Unit of the police command during the gunfight.
He said: “Some extremists launched an attack with bombs and assault rifles on Dala Police Station, Jakara Police Barracks, Goron Dutse Division, Panshekara Division, 52 Squadron Mobile Police Unit, Challawa; and also planted bombs at the Junior Secondary School, Sabuwar Doka in Ungogo Local Government.
“The extremists, who were about 30, attacked policemen on duty with assault rifles and IEDs, and the policemen gallantly repelled the attacks.”
He added that the ‘’extremists’’ also attacked the Goron Dutse Prison yard, but the policemen on duty repelled their attacks successfully. He said no damage was done to the prisons, even as the situation was now under control.
The police boss, however, revealed that the command lost a police Sergeant just as another sergeant sustained injuries.
According to him, items recovered from the religious extremists included five assault rifles, 220 live ammunition, five vehicles, three motorcycles, large quantities of drugs and syringes, and N100,000 cash.
The Commissioner, however, commended the people of the state for their cooperation with law enforcement agencies and urged them not to relent in providing useful information.
However, commenting on the incident in Damaturu, the Yobe State Police Commissioner, Patrick Egbuniwe, said in a telephone interview yesterday that “there were attacks on a police and military posts by suspected gunmen, where two civilians were killed in the Sabon Fegi ward and the Federal Polytechnic staff quarters.”
He said there were still some assailants hiding among the communities in the metropolis, warning that the police and JTF would continue to raid such hideouts, which pose increased security threats to lives and property in the state.
He said there was no casualty during Tuesday’s attacks on the part of men of the JTF and police, urging the residents to always cooperate with security agents, by providing useful information on the hideouts and modus operandi of terrorists in their midst.

Is It a Dead End for the Farouk Lawan vs Femi Otedola Bribery Scandal?


With the embattled Chairman of the House of Representatives ad hoc committee on fuel subsidy, Mr. Farouk Lawan’s insistence that he gave the alleged bribe money to the Chairman, Committee on Narcotics and Anti-corruption, Adams Jagaba, Police investigators are now in a dilemma over the whereabouts of the $620,000 bribe.
After Mr. Lawan confessed to receiving the bribe money from the Chairman of Zenon Oil and Gas, Mr. Femi Otedola, he said he gave the money to Mr. Jagaba who denied ever receiving the money in an official statement.
Now, it seems that the Special Task Force is not making much progress in the investigation because of its inability to know the whereabouts of the money.
The Police probe into the matter is compounded by the refusal of the State Security Service to provide the Special Task Force with the original copy of the video recording of what transpired between Lawan and Otedola.
Meanwhile, Jagaba and members of the committee on fuel subsidy have shunned police invitation. They were expected to appear before the STF on Wednesday, but only Lawan and the clerk of the ad hoc committee, Boniface Emenalo, turned up.
However, Jagaba wrote the Inspector-General of Police, Mr. Mohammed Abubakar, saying he did not collect any money from Lawan.
Sources said the STF is now confused about the next step to take, following the ‘dribbling‘ by Lawan and the refusal of other committee members and Jagaba to honour police invitation.
Other committee members that were invited had yet to appear before the police too.
“Investigators are confused and didn’t know what to do because Lawan kept dribbling them about the whereabouts of the money and it seems the STF is intimidated by the caliber of people involved in the matter.
“I think the fact that the Inspector-General of Police, is in acting capacity is an issue and that may be why the police are afraid to go tough with the lawmakers.
“The fact that the SSS has not been cooperating with us by releasing materials in its possession is not helping the matter. This investigation is heading for the rock,” the source said.
When the news of this bribery scandal first broke out, a lot of people said it would end up just this way – at a dead end. Although investigations are still ongoing, considering the recent turn of events, many have lost faith that justice would prevail in this case.

Police to Make Farouk Lawan Confront Jagaba

The police may have reached a dead end in their investigation into the whereabouts of the $620,000 that the suspended Chairman, House of Representatives Ad hoc Committee on the Monitoring of Fuel Subsidy, Hon. Farouk Lawan, collected from oil magnate, Mr. Femi Otedola.
Lawan, who was at the Force Headquarters Wednesday, insisted that the money was with the Chairman, House Committee on Narcotics and Financial Crimes, Hon. Adams Jagaba, who had rebutted his claim that he wrote a letter in which he informed him (Jagaba) of attempts to bribe the ad hoc committee and attached the money to it.
Sources told THISDAY that given the conflicting claims of Lawan and Jagaba and their insistence that their narration of the event was the truth, the police are planning to bring both of them together to confront each other.
However, notwithstanding the conflicting claims and the growing uneasiness that the bribe-for-clearance scandal could rubbish the report of the ad hoc committee, House Speaker, Hon. Aminu Tambuwal, assured the public Wednesday that legislature would ensure that the report is implemented.
One of the sources said that investigation to find out who has the money has also being stalled by the alleged refusal of the State Security Service (SSS) to assist the police with the videotape of Lawan taken while collecting the money from Otedola.
Although the police had written to Jagaba, inviting him to appear at the Force Headquarters to meet the investigators the lawmaker did not show up, but rather wrote and denied either seeing the letter or the money.
“The police are confused by Lawan’s refusal to cooperate and bring the money and they have requested Jagaba to come and confront Lawan so that they can know who is lying between them,” the source said.
Sources said that the Special Task Force, set up to investigate the scandal is considering the next step to take following the ploy by Lawan to cover up the whereabouts of the money and the refusal of other committee members and Jagaba to honour police invitation.
“Investigators are confused and didn’t know what to do because Lawan kept dribbling them about the whereabouts of the money and it seems the STF is intimidated by the calibre of people involved in the matter, ” another source stated.   

Efforts to get clarification from police spokesperson, Frank Mba, a Chief Superintendent of Police, proved abortive as he said the police would not comment on the matter while investigation is ongoing.
Tambuwal, in Asaba yesterday, however, said no amount of blackmail or intimidation would make the House to dump the ad hoc panel report.
The speaker, while declaring open the Delta State House of Assembly public lecture to mark the first anniversary of the Fifth Assembly,  said those indicted in the report would be held accountable for their actions.
He assured Nigerians that irrespective of the present diversionary tactics of some people, the House would ensure that the report is implemented.
Tambuwal said it was unfortunate that people would go to any length to make Nigerians lose confidence in the report, he gave the assurance that the House was irrevocably committed to the report.
The speaker who used the occasion to call for cooperation between the legislature and the executive, said it was only through that would Nigerians enjoy the dividends of democracy.
He stressed the need for the three arms of government to cooperate with one another to ensure the wellbeing of the citizens.
Tambuwal also urged the legislature to exercise its function diligently, as the legislature remained the trustee of the people.
He described the functions of the legislature as sensitive because they touched on the fabric of the society just as he implored lawmakers to live above board, ensure probity, transparency and accountability in the discharge of their responsibilities.
Delta State Governor, Dr. Emmanuel Uduaghan,  said in his speech at the occasion that his administration was working harmoniously with the different arms of government in the state to deliver the dividends of democracy to the people.
He explained that the major challenges facing the state were security, human capital development and infrastructural decay, stressing that his administration would do all it could to redress the situation.
Uduaghan  said job creation was one of the programmes his administration was using to solve  the challenges of kidnapping and other crimes  facing the state.

“We cannot achieve our goal as a state without the legislature; that is why we take the development of our legislature in Delta State seriously. The legislature has been supportive to the state policies. “There has been cooperation between the executive and the legislature. Whatever decisions the legislature and executive take are for the benefit of all Deltans. I assure you that we will continue to work together,” he added.
The host and Speaker of the state legislature, Hon. Victor Ochei, said the lawmakers were collaborating with the executive to ensure the development of the state.
He thanked Uduaghan for his continuous support and interest in the affairs of the House and pledged the lawmakers’ cooperation at all times.

Kenyan athlete Ezekiel Kemboi quizzed over stabbing

Kenyan police have been questioning the world's 3,000m steeplechase champion, Ezekiel Kemboi, after a woman he was with on Wednesday night was stabbed.
Anne Njeri Otieno alleges that the athlete attacked her when she declined his sexual advances.
Mr Kemboi told police he was dropping her home in the western town of Eldoret when they were ambushed by thugs and she was injured in the skirmish.
The athlete, a serving policeman, is preparing to go to the London Olympics.
Senior investigative officer Charles Chamanda told the BBC that the police have recorded statements from both Mr Kemboi and Ms Otieno, who is in a stable condition in hospital.
The BBC's Wanyama Chebusiri in Eldoret says Mr Kemboi has spent several hours at the town's police station being questioned.
The station has been jammed with hundreds of curious onlookers, and officers have had difficulty controlling the swelling crowd, he says.
Ms Otieno told reporters that she had been out drinking with Mr Kemboi when he offered her a lift home.
The 2004 Olympic gold 3,000m steeplechase winner told police that the attackers pounced on him when he was outside the car, demanded money and then attacked him.
He said he acted in self-defence to dodge them and his companion was stabbed.

It says scores have been killed and injured in indiscriminate attacks on civilian areas by both a rebel group and the South Sudanese army.
The group says a "ready flow of weapons" includes Sudanese weapons, Chinese landmines and Ukrainian tanks.
There has been no official reaction from any of the countries to the allegations.
The tanks - used by the South Sudanese army, according to Amnesty - were clandestinely delivered to the SPLA between 2007 and 2009 via Kenya, as part of a transfer involving Ukrainian, German and UK firms, the report says.
"This delivery took place despite the 2005 Comprehensive Peace Agreement between Sudan and South Sudan's ruling Sudan People's Liberation Movement (SPLM), and an EU embargo on Sudan which at the time also covered South Sudan," the group said in its report.
The report focuses on conflict in Mayom County, in the western part of Unity State.
It says that the use of "unguided, indirect-fire mortar and artillery shells" to bombard military targets "failed to discriminate adequately between civilians and military targets", in violation of international humanitarian law.
The group is urging governments around the world to stop selling weapons to countries where there is a "substantial risk" that they could be used to commit human rights abuses.
The BBC's James Copnall, in Khartoum, says that the detail of the report is likely to prove controversial though another organisation, Small Arms Survey, has come to similar conclusions in the recent past about the origins of the weapons.
South Sudan gained independence from Sudan last July, after a long civil war. South Sudan ended up with most of the area's oil fields, although it has to export the oil using pipelines through ports in Khartoum's territory.

Burma's Suu Kyi Begins Historic Europe Visit

Burmese pro-democracy leader, Aung San Suu Kyi has arrived in Geneva, where she will address the United Nations at the start of a visit to Europe, reports the BBC.
She is due to make a speech at the UN's International Labour Organisation, which has led a long campaign against child and slave labour in Burma.
Aung San Suu Kyi spent much of the past 24 years under house arrest in Burma.
The visit, her first to Europe since 1988, is seen as another milestone for the country's political progress.
During a tour lasting over two weeks, she will visit the UK, Switzerland, Ireland, France and Norway, where she will accept her 1991 Nobel Peace Prize.
Correspondents say Aung San Suu Kyi is addressing the ILO in recognition of its longstanding focus on the poor human rights record of former Burma's military rulers.
It is her second recent overseas trip, after visiting Thailand in May.
She told reporters before she left Burma that she expects the trip to Europe to be eye-opening.
"Each country will be different. I will know how backward [Burma] is when I reach the other countries," she said.
She also added that she "would like to do my best for the interests of the people".
Ms Suu Kyi has spent much of the past two decades under house arrest as a political prisoner. But as part of Burma's recent reform process, she was freed in late 2010 and won a seat in parliament in by-elections in April this year.
Her decision to travel is seen as a sign of confidence in the government of President Thein Sein, who has pursued a course of reform since coming to power last year, in Burma's first elections in 20 years.
Aung San Suu Kyi is the daughter of Burmese independence leader Aung San, who was assassinated in 1947.
She became the leader of Burma's pro-democracy movement when, after living abroad for many years, she returned to Burma in 1988, initially to look after her sick mother.
After that, she did not leave the country until recently, fearing that the country's then military rulers would not allow her to return to Burma.
The decision meant that she was unable to receive in person her Nobel Peace Prize, awarded in 1991, or be with her British husband, Michael Aris, when he died in 1999.

Rihanna: I hate being a size zero



Rihanna has revealed that she is not happy with her body.

The 24 year-old Barbadian singer has dropped a considerable amount of weight in recent months. She told Us Weekly that she wants to put back on a few pounds to return to her old self.

“I’m a size zero and I’m not happy about it!” she told the publication. “I went way too far. I prefer myself a bit chunkier. I want my old butt back!”

Rihanna also addressed being hospitalised after the Met Ball gala last month.

“I got no sleep [beforehand],” she shared. “It’s harsh on your body!”

But the diva already has her next career steps in place following her breakout film role in Battleship earlier this year.

“I want to do two more [movies] before touring again next year,” Rihanna insisted. “My schedule is crazy!”

Rihanna recently posted a video message to her fans from bed apologising for not being in contact as she focuses on family time.

“I know I’ve been slacking on my social-networking but I’m spending some time with my grandma,” she said speaking about her ill relative. “I miss you guys.”

Islamist militants taking advantage of chaos in Mali

Mali has seen an influx of Ansar Dine militants who want to impose sharia law in the country.

Sevaré, Mali (CNN) -- The town of Niafunke, on the banks of the River Niger, was made famous by the legendary Ali Farka Toure, one of a legion of great guitarists to emerge from Mali.
But nowadays, Niafunke is known as a battleground as Mali disintegrates and a mix of hard-line Salafi Islamists and ethnic Tuareg rebels tighten their grip on the northern two-thirds of the country.
Malik, an English teacher from the town, knows just how hard-line the new arrivals are. He said a friend was brutally beaten on a Niafunke street after Salafists caught him with a flask of alcohol in his pocket. Malik also enjoys beer, a cigarette and music -- all "vices" abhorred by the Salafists of a movement known as Ansar Dine -- so he fled.
His story is all too typical. Mali, traditionally a tolerant society, has become bitterly divided in the wake of a rebellion by the Tuareg, a nomadic people who inhabit the north of this country as well as areas of Niger, Libya, Burkina Faso and Algeria.
Niafunke was one of the initial towns the Tuareg attacked in January, sparking a coup by disgruntled Malian soldiers. The soldiers, running low on ammunition and food in the face of rapid rebel advances, abandoned their northern bases en masse. They felt that political elites in the far-off capital of Bamako had virtually abandoned them.
Into the chaos has stepped Ansar Dine, a Tuareg-led Islamist militant group whose primary objective is to impose sharia law in Mali, and an exodus of well-armed Tuareg from Libya, where many fought for Moammar Gadhafi. No longer welcome in post-Gadhafi Libya, these battle-hardened Tuareg fighters traversed Saharan pistes to return to their homeland in northern Mali, which is known as Azawad in their indigenous      language.                                                                                                                                    Gadhafi's spy chief goes on trial in Libya 
The separatist National Movement for the Liberation of Azawad, or MNLA, formally declared its independence from Mali in April, and last month it announced that had joined forces with Ansar Dine. The MNLA cooled to this alliance when the two could not agree on how it would share power, but Mali, one of Africa's poorest countries, is now in a state of protracted limbo.
And it's this uncertainty -- this messy, unpredictable war in a country known as Africa's crossroads -- that threatens the region and has created concern that northern Mali could become a new terrorist haven.
Stalemate of suspicion
Nearly 400 miles northeast of Bamako, along a winding, dusty highway dotted with spartan roadside villages, is the town of Sevaré. Malian security forces have erected a series of checkpoints around the town that amount to internal border crossings.
To travel farther north, toward rebel-held territory, invites extreme suspicion. Those on ancient, creaking buses bound for Gao or Timbuktu have their belongings meticulously pulled apart by cautious local police. At Sevaré's southern edge, passengers queue up in the stifling midday heat at a garbage-strewn checkpoint to press their case for heading into rebel-held lands. There is scant sympathy for their plight. After passing through the city, they are then subject to another checkpoint on its northern fringe.
Beyond Sevaré is the town of Konna, on the banks of the Niger. It is supposedly held by a dispirited mix of Malian troops, gendarmes, national guard and police. It is the last population center claimed to be in government hands. But Muhammed, a young Tuareg employed by a British nongovernmental organization, described Bamako's hold on Konna as more tenuous than the central government was admitting.
Douentza, 75 miles away, is now in the hands of the MNLA. The famed city of Timbuktu, not so long ago a popular tourist destination for adventurous Europeans, is now ruled by Ansar Dine. MNLA forces are more prevalent in Azawad's southern hinterlands, while the better-funded, better-equipped Ansar Dine is primarily in control of the cities. The Salafists have closed bars, attempted to ban smoking and forced women to wear veils in a bid to implement gender segregation.
Mousa, a multilingual art dealer from Timbuktu who has spent considerable time in the United States hawking the work of local Malian artisans, made a hurried departure well before the rebel takeover. He went from doing a roaring trade with Western tourists to becoming an internal refugee in a matter of months.
"I left before the rebels entered the city," he said. "After hearing about their attacks in the (far) north, I knew they would come (to Timbuktu)." He now lives in uncertainty in a town near Sevaré.
Not all Tuaregs back the cause of an independent Azawad.
Zeidan ag Sidi Lamine, a former rebel now living in Bamako and part of the Malian government, said talks with the rebels were possible if it would accept the country's territorial integrity. He said Ansar Dine and the MNLA must accept "that tolerance of religious difference is non-negotiable, and the nation's diversity must be preserved," respectively.
When asked whether he would he would be willing to take part in peace talks with either group, Sidi Lamine instantly responded, "Of course I would accept." But he believes that the self-declared "Islamic State of Azawad" is destined to unravel for two reasons: because the more nationalist MNLA did not consult the local population before declaring independence, and because it would be impossible for Ansar Dine to enforce sharia law over the long term due to Mali's inherent diversity.
Mousa, the art dealer, says that the revolt was partly motivated by another important factor and that it would not be easily undone.
"It is racism, plain and simple," he said. "The Tuaregs do not want to be ruled by Bambaras, Fulanis or Songhais," three of Mali's principal peoples.
The reality driving this Tuareg revolt is more likely a complex hybrid of several factors, including ethnic nationalism, political isolation and a lack of economic opportunity. On top of that is the austere brand of Islam being espoused by Ansar Dine.
The military stalemate is compounded by political paralysis. Amadou Sanogo, the army captain who overthrew President Amadou Toumani Touré in March, had pledged to retake the embattled north. He has since technically stepped aside in favor of interim President Dioncounda Traore.
Traore, however, is in a Paris hotel after being beaten unconscious in a May 21 attack that occurred in the presidential palace. In Traore's absence, Mali is being effectively led by interim Prime Minister Cheick Modibo Diarra, a former NASA engineer who holds U.S. citizenship.
Diarra has hinted at trying to push the rebels back, and there are reports of troops being mobilized from southern garrisons to Sevaré, which could serve as a launch pad for a counterinsurgency campaign. But the town's threadbare garrisons suggest the army and gendarmerie would be ill-prepared to take the offensive. Only a handful of armored personal carriers and technical fighting trucks were evident. Most soldiers and gendarmes buzz around town on motor scooters more suited to running errands than fighting a war.
A magnet for jihadists
For the United States, the collapse of Mali poses multiple headaches beyond the humanitarian crisis that many have been striving to prevent. Its counterterrorism program here is in abeyance, just as al Qaeda in the Islamic Maghreb, the Movement for Unity and Jihad in West Africa, and other freelance jihadists expand their presence.
Al Qaeda in the Islamic Maghreb has made millions of dollars through ransom payments for Western hostages. This money is thought to have been spent on a more sophisticated arsenal that may, according to some Western intelligence estimates, include ground-to-air missiles looted from Gadhafi's arsenals. While specifics regarding this more sophisticated weaponry remains speculative for the time being due to a dearth of verifiable intelligence in the Azawad region, what is known is that this sprawling, ungoverned area is becoming a magnet for regional and even transnational jihadists, according to several witnesses.
Basically, Mali remains in political freefall while quarrelsome rebels attempt to consolidate their control over an area the nearly the size of Texas.
After early efforts regarding a possible military intervention were rebuffed by Sanogo's junta, the West African regional body ECOWAS is taking the issue to the U.N. Security Council. Mahamadou Issoufou, the president of neighboring Niger -- a nation long plagued by its own Tuareg revolts -- has been sounding the alarm bell on the looming danger of jihadists controlling territory in Mali. Jean Ping, the chairman of the African Union, also plans to raise the Azawad issue at the U.N. in coming days.
It's a situation that the late guitarist Toure, whose album "Talking Timbuktu" won a Grammy, would not recognize.
"For some, Timbuktu is a place at the end of nowhere," he once said. "But that's not true. I'm from Timbuktu, and I can tell you that it's right in the center of the world."

It is a tribute to the validity of that day, that 19 years after, the June 12, 1993 presidential election still retains its relevance, even after the country has experienced 13 unbroken years of democratic rule.

Yesterday, politicians, especially those who have anchored their ideology on progressivism, once again, gathered at various fora across the nation to celebrate the date.

This year’s commemoration seems to have been predicated on a defined theme, which focused on either the recent national honour bestowed on the late Chief Moshood Kashimawo Abiola by the Federal Government, or demands for an even greater honour by the Federal Government.

President Goodluck Jonathan, had on May 29, during his Democracy Day broadcast, announced that the University of Lagos (UNILAG) had been re-named Moshood Abiola Univeristy, Lagos, in honour of his contribution to the democratic struggle in Nigeria.

But the Oyo State Governor, Abiola Ajimobi, and some other pro-democracy activists, at different fora, urged the Federal Government to officially recognise Abiola as a former president of the country and confer on him, the highest honour in the land befitting of a president. 

The governor argued: “To have continued with this perennial silence on the democratic feat that Abiola wrought through his sheer bravery and belief in Nigeria would show to the whole world that we are an ungrateful nation. But for Abiola and his bravery in choosing to die, rather than allow his mandate to be exchanged for the biblical mesh of pottage, we would perhaps still be in the bondage of military rule and crying out for democratic salvage.”

Also at a  forum organised by the Voters Assembly (VOTAS) in Ibadan, pro-democracy activists held the view that Abiola had not been appreciated enough by the government and insisted on his recognition as a president-elect as well as the conferment of the Grand Commander of the Federal Republic (GCFR) on him.

But aside the clamour to formally accord the late Abiola the status of a former president, some political leaders like former Kaduna State governor, Alhaji Balarabe Musa, former Lagos State governor, Mr. Bola Tinubu, and his successor in office, Mr. Babatunde Fashola, have not only called for a Judicial Commission of Inquiry to unravel the mystery behind the annulment of the election, but also urged the government to establish a national monument in honour of the late politician.

According to Musa, who chaired the event, the  latter-day declaration of the chairman of defunct  National Electoral Commission (NEC), Professor Humphrey Nwosu, that Abiola won the June 12 election as well as the recent decision of Jonathan to rename UNILAG after him has made the annual commemoration of June 12 anniversary even more justifiable.

Also speaking, Tinubu argued that Nigeria had largely derailed from the practice of true democracy as he condemned the amendment to the constitution in a way that restricts the contest of elections in court to only 180 days. “If anyone says that we have democracy now, maybe in 1999 when we started, I would say yes. But now, we do not have democracy, justice and freedom. The danger is here.

“We had the rule of law until a few years ago when the National Assembly amended the constitution and took our right away through the back door. We were able to retrieve stolen mandates in Osun, Ekiti and Edo. But immediately they noticed it, they went ahead to amend the constitution to limit the rights of Nigerians to fair hearing to 180 days,” he alleged.

In Ogun State, the celebration kicked off with a ‘Democratic Walk’ led by the state governor, Senator Ibikunke Amosun, from the Government house through the late Abiola’s House and terminated at the MKO Abiola Stadium. At Abiola's house, the head of the family, Alhaji Bashiru Abiola, lamented that despite the acknowledgement of late Abiola's electoral victory at the said election, the Federal Government had neglected the family. He however appreciated the visit of the governor, to which Amosun promised the family a better deal henceforth.

As a show of his disapproval of military rule, Lagos-based lawyer, Mr. Femi Falana, yesterday canvassed for the removal of names of the former military heads of state from the Council of State meeting. He argued that they were not qualified to be part of the meeting.
Speaking at a lecture to commemorate the 19th anniversary of the June 12, 1993 election organised by civil society coalition groups in Osun State, Falana said it was unconstitutional and illegal to allow former military heads of state to be part of Council of State meeting.

Governor Rauf Aregbesola also joined the clamour for the Federal Government to declare June 12 MKO Abiola Day to honour him. Aregbesola disclosed that Osun State had declared the day MKO Abiola Day. He promised that a bill would soon be sent to the House of Assembly in order to back the declaration with the force of law.

According to Aregbesola, “No one can pay the price Abiola paid for us to have the democracy that we have now. He paid for this democracy with his money, name and his life. The complete result of that election must be released and Abiola declared president instead of referring to him as the presumed winner of June 12 presidential election.

But exultant as the progressives were, the Peoples Democratic Party (PDP) believed the celebrations, especially as anchored by the ACN governors was misplaced. PDP in the South-west described the celebration of June 12 by Action Congress of Nigeria (ACN) governors as a blatant and shameless display of hypocrisy.

PDP Zonal Publicity Secretary, Hon. Kayode Babade, said in a statement that “rolling out drums and wasting public funds on media exaltation and ugly lectures in the name of June 12 cannot cover the hatred the ACN has for MKO Abiola’s family, legacies and ideals.”
The statement read: “Today, they are celebrating June 12. They have declared a public holiday. They are making beautiful speeches. Yet, these same people were the ones, who protested the loudest when University of Lagos was renamed Moshood Abiola University, Lagos.

“They were the ones, who denied MKO Abiola's son a House of Representatives ticket in Ogun State. Yet they say they love MKO Abiola, and we ask, what have they done for MKO Abiola's family, legacies and ideals since they assumed office? Is June 12 about denial of rights to vie for party tickets? Would there have been a June 12 for them to celebrate if MKO Abiola had been denied the rights to participate in an open primary election as the ACN did to his (Abiola) son?"

President Jonathan Arms Nigerian Civil Defence With Sophisticated Weapons

President Goodluck Jonathan and his security advisors today began moves to end the Boko Haram insurgency by arming the Nigerian Security and Civil Defence Corps (NSCDC) to complement the efforts of the Nigerian armed forces and the police.

A military source in Abuja told SaharaReporters that the corps received about 5000 sophisticated guns (G3) and 250, 000 rounds of ammunition in a Kaduna military base.
The source said that the Minister of the Interior, Mr. Abba Moro, stood in for the president at the ceremony.  The boss of the NSCDC, Ade Abolurin, led his corps. Major General Garba Wahab, head of the military base in Kaduna, represented the Nigerian Army.
It was learnt today that members of the corps have been undergoing rudimentary military training all over the country.  A source said that the corps will help to address a shortage of man power and other logistics.
The NSCDC is a para-military agency of the federal government mandated to provide measures against threats and any form of attack or disaster against the nation and its citizenry.  It was first introduced in May 1967 during the Nigerian Civil War within the then Federal Capital Territory of Lagos for the purpose of sensitization and protection of the civil populace. It was then known as Lagos Civil Defence Committee.  In 1970, it became the Nigeria Security and Civil Defence Corps.

“Beautiful Onyine” is a slow groove highlife song off P-Square’s fifth album ‘Invasion’ and the news of its release comes hot on the heels of them signing of a distribution deal with Universal Music Group.
